Restoration of Temporary Resident Status

Losing temporary resident status in Canada does not always mean that the situation cannot be corrected, but restoration is different from an ordinary extension and is not automatic.

If your visitor, student or worker status has already expired, the first step is to determine when status was lost, why it was lost, whether restoration is still available and what status you should be seeking to restore.

Anka Canada Immigration Consulting can review your immigration history and current circumstances to help identify the appropriate next step before another application is filed.

Services are provided by Volkan Sacilik, RCIC-IRB, CICC Licence No. R1042981.

What Is Restoration of Status?

Restoration is a process that may allow a visitor, student or worker who has lost temporary resident status in Canada to regain legal temporary status.

Under the regular rules, an eligible person generally must apply within 90 days of losing status, continue to meet the applicable requirements and explain the circumstances that led to the loss of status. Restoration is discretionary and approval is not guaranteed.

Who May Need Restoration?

Restoration may become relevant where, for example:

  • a visitor remained in Canada beyond the authorized period;

  • a study or work permit expired before a proper extension application was submitted;

  • a worker changed employment conditions without obtaining the required authorization;

  • a student failed to comply with a condition attached to the study permit.

The exact restoration strategy depends on the status previously held and what the person now intends to do in Canada.

Restoration Is Not Maintained Status

If a qualifying extension application is submitted before status expires, the person may benefit from maintained status while IRCC processes the application.

Restoration applies after status has already been lost.

This distinction matters because a person applying for restoration generally cannot continue working or studying simply because a restoration application has been submitted. Workers must normally stop working, and students who have lost status must stop studying until status and the required authorization are restored.

What If More Than 90 Days Have Passed?

Under the regular restoration rules, a person who has been without status for more than 90 days will generally not qualify for ordinary restoration and may need to leave Canada and apply again from outside Canada.

However, temporary public policies or special measures can sometimes create exceptions for specific groups. For example, certain people directly affected by Canadian natural disasters between 2026 and 2028 may have up to six months to seek restoration.

This is why the applicable rule should be checked against the person’s actual circumstances rather than assuming the standard 90-day rule always resolves the situation.

What Should Be Reviewed Before Applying?

A restoration application should address more than the expiry date.

Relevant issues may include:

  • exactly when and how status was lost;

  • whether unauthorized work or study occurred;

  • whether the applicant complied with the remaining conditions of the previous status;

  • what status or permit is now being requested;

  • whether the person still meets the requirements for that status;

  • whether another immigration application should be filed at the same time.

Choosing the correct restoration route can be just as important as explaining why status was lost.

How Anka Canada Immigration Consulting Can Assist

Anka can review your previous permits, entry records and immigration applications to determine whether restoration may still be available and which status should be requested.

Where retained, we can also prepare the restoration application, organize supporting evidence and explain the circumstances that resulted in the loss of status.

The objective is to help ensure that the correct restoration process is used and that status, timing and authorization issues are identified before the application is submitted.

Important Information

Restoration rules and temporary public policies can change. Eligibility depends on the applicant’s immigration history, timing and individual circumstances. Information on this page is general and does not guarantee restoration or any other immigration outcome.
