Spousal Open Work Permit (SOWP)
A Spousal Open Work Permit (SOWP) can allow an eligible spouse or common-law partner to work in Canada without being tied to one specific employer. However, being married to or in a common-law relationship with a student, worker or permanent residence applicant does not automatically create eligibility for an open work permit.
The applicable rules depend on the principal applicant’s immigration category, studies or employment, permit validity and the couple’s circumstances. Confirming the correct eligibility route before applying can help avoid filing an application under a category that does not apply.
Anka Canada Immigration Consulting assists couples with assessing SOWP eligibility and preparing applications based on their immigration and relationship circumstances.
Services are provided by Volkan Sacilik, RCIC-IRB, CICC Licence No. R1042981.
What Is a Spousal Open Work Permit?
A spousal open work permit is generally not tied to a particular employer or job. An eligible holder can normally work for most employers in Canada without an LMIA or employer-specific job offer, subject to any conditions printed on the permit.
Eligibility comes from a specific immigration program or public policy. There is no single SOWP category available to every spouse or common-law partner.
Spouses of International Students
Since January 21, 2025, SOWP eligibility for spouses of international students has been significantly restricted.
A spouse or common-law partner may qualify where the student holds a valid study permit and is enrolled in:
-
a master’s degree program of 16 months or longer;
-
a doctoral program;
-
certain designated professional degree programs; or
-
another specifically eligible program identified by IRCC.
A spouse should therefore not assume that attending a Canadian college, university or graduate program automatically creates SOWP eligibility
Spouses of Foreign Workers
Eligibility for spouses of temporary foreign workers also depends on the principal worker’s circumstances.
For many workers who are not already on an eligible permanent residence pathway, the principal worker generally must be employed in:
-
a TEER 0 or 1 occupation; or
-
certain specifically listed TEER 2 or 3 occupations,
and their work authorization normally must remain valid for at least 16 months after IRCC receives the spouse’s application.
Different rules can apply to workers on certain permanent residence pathways, special programs or free trade agreement categories.
This is why identifying the principal worker’s exact NOC, work permit category and remaining permit validity can be important before submitting the spouse’s application.
Other Spousal Open Work Permit Pathways
A SOWP may also be available in other circumstances.
For example, certain spouses or partners being sponsored for permanent residence while living in Canada may qualify for an open work permit once the applicable sponsorship and processing requirements are met.
Other open work permit rules can apply to family members of certain economic permanent residence applicants and workers participating in designated programs.
The correct category should therefore be identified from the applicant’s actual immigration situation rather than simply selecting “spousal open work permit.
What Should Be Reviewed Before Applying?
Depending on the SOWP category, relevant issues may include:
-
the principal applicant’s study or work permit;
-
program of study or occupation;
-
NOC and TEER classification;
-
remaining permit validity;
-
proof of current enrolment or employment;
-
proof of the marriage or common-law relationship;
-
the spouse’s current status in Canada, if applicable;
-
previous immigration applications and refusals.
Relationship evidence and the principal applicant’s eligibility should also be consistent with the information previously provided to IRCC.
Common Issues in SOWP Applications
Applications may become more complicated when:
-
an outdated eligibility rule is relied on;
-
the student’s program does not qualify;
-
the worker’s occupation or permit validity does not meet the applicable requirements;
-
a PGWP applicant is treated as if they already hold an approved qualifying work permit;
-
the relationship evidence is incomplete or inconsistent;
-
the applicant assumes that an existing SOWP can always be extended under the same rules.
Because SOWP eligibility has changed significantly in recent years, reviewing the applicable category before filing can prevent an application from being prepared on the wrong legal basis.
How Anka Canada Immigration Consulting Can Assist
Anka can review the principal applicant’s immigration status, study or employment circumstances and the couple’s relationship documentation to determine whether a current SOWP pathway may apply.
Where retained, we can prepare the work permit application, organize supporting documentation and identify eligibility, status or consistency issues that should be addressed before submission.
The objective is to ensure that the open work permit category being relied on actually applies to the couple’s circumstances before the application is filed.
