Humanitarian & Compassionate (H&C)
Service Description
This service is for foreign nationals in Canada who may seek permanent residence on humanitarian and compassionate (H&C) grounds because their circumstances justify an exemption from the usual requirements of Canadian immigration law. H&C is an exceptional and discretionary process, not simply an alternative immigration pathway. Following the initial consultation, we assess whether H&C is appropriate and whether any restrictions or timing issues apply. We review your immigration and status history, previous applications or refugee proceedings, establishment in Canada, family ties, the best interests of any children directly affected, health or family-violence considerations, hardship associated with leaving Canada, and other relevant factors. We also identify the exemptions being requested and the evidence needed to support them. If you proceed, the scope of representation and professional fees are confirmed in a written Service Agreement. You will receive a case-specific evidence plan and document checklist. Supporting evidence may include employment and tax records, community involvement, family relationships, support letters, children's school or medical records, health documentation, and relevant country information. We prepare the required forms and written representations explaining how the evidence supports the H&C request and addressing relevant immigration-history concerns. Before submission, the application is reviewed for consistency, completeness and evidentiary strength, then reviewed with you and submitted only after your confirmation. We remain your authorized representative within the agreed scope, monitor the application and assist with IRCC correspondence and material updates. Online meetings are arranged as needed, with ongoing communication by WhatsApp, email and telephone. The fees shown are professional fees for ANKA Immigration's services only. IRCC/government fees, biometrics, medical examinations, translations, expert reports and other third-party costs are not included. Fees may vary based on family size, prior refusals or proceedings, status or removal issues, and case complexity. Submitting an H&C application does not by itself extend status, authorize work or study, or stop removal from Canada. H&C is not a substitute for a refugee claim; protection risks are assessed under different processes.
